Salary Range

The minimum and maximum annual salary or hourly wage an employer, in good faith, believes it would pay for an advertised position.

Definitions (2)

Under New York City Local Law 32 of 2022, 'Salary Range' refers to the lowest and highest annual salary or hourly compensation that an employer, at the time of posting an advertisement for a job, promotion, or transfer opportunity, genuinely believes it would pay for that specific position. This range must be provided in 'good faith,' meaning it should be a realistic and honest assessment based on factors such as market rates, internal pay scales, and the specific requirements of the role. It does not include other forms of compensation like bonuses, benefits, or overtime.

Under the Minnesota Pay Transparency Act, 'salary range' is defined as the minimum and maximum annual salary or hourly range of compensation for a job opportunity. This range must be based on the employer's good faith estimate at the time the job posting is made and cannot be open-ended. If an employer does not intend to offer a salary range, they must instead list a fixed pay rate for the position. This ensures applicants receive clear and actionable compensation information.
