Workplace Sexual Harassment
Unwelcome sexual conduct or gender discrimination in the workplace that creates a hostile environment or affects employment conditions.
Definition
Workplace sexual harassment encompasses two main scenarios: first, when an individual, during the performance of their duties, makes sexual requests, uses verbal or physical conduct of a sexual nature, or exhibits gender discrimination, thereby creating a hostile, intimidating, or offensive working environment that infringes upon personal dignity, physical liberty, or affects job performance. Second, it includes instances where an employer explicitly or implicitly makes a sexual request, uses sexual verbal or physical conduct, or exhibits gender discrimination as a condition for employment, promotion, or other job-related decisions. The 2023 amendments expanded this to include incidents occurring during non-working hours under specific conditions, broadening the protective scope.
