Definition

The concept of 'work of equal or comparable value' is central to the equal remuneration provisions of the Fair Work Act 2009. It encompasses not only work that is identical but also work that, while different in its specific tasks or nature, can be objectively assessed as having equivalent value based on factors such as skill, effort, responsibility, and working conditions. The Fair Work Commission, when considering equal remuneration orders, is guided to take into account comparisons within and between occupations and industries to establish whether work has been undervalued on the basis of gender, without being limited to comparisons with historically male-dominated occupations.
