Victimization

Any adverse treatment against an employee for exercising legal rights or making a complaint.

Definition

In the context of Law no. 283/2022, victimization is redefined and expanded to include any adverse treatment, unfavorable action, or retaliation by an employer against an employee. This occurs as a direct consequence of the employee filing a complaint, making a notification to competent bodies, or initiating a legal action concerning the violation of their legal rights, including those related to the principle of equal treatment and non-discrimination. This definition aims to provide robust protection for employees who assert their entitlements under the Labour Code.
