Victimisation, also referred to as unjustified sanction or retaliation, is explicitly prohibited under the Act. It occurs when a person is subjected to adverse treatment, such as dismissal, demotion, or harassment, because they have made a complaint of discrimination, participated in proceedings related to discrimination, or supported another person who has experienced discrimination. This protection is crucial to encourage reporting and ensure individuals can assert their rights without fear of reprisal.
Victimisation refers to treating a person less favourably because they have made a complaint, given evidence, provided information, or otherwise participated in proceedings under the Family Status Discrimination Ordinance, or alleged that an unlawful act has occurred. It is prohibited to protect complainants from retaliation.
Victimisation is unlawful under the RDO and occurs when a person treats another person less favourably because that other person has made a complaint, given evidence or information in connection with proceedings under the anti-discrimination ordinances, or alleged that a contravention of the ordinances has occurred, or intends to do so.
