Definition
Unmittelbare Benachteiligung, or direct discrimination, occurs when a person receives less favorable treatment than another person in a comparable situation because of a reason specified in Section 1 of the AGG. This explicitly includes unfavorable treatment of a woman due to pregnancy or maternity, which is considered direct discrimination based on gender. It is a straightforward form of discrimination where the protected characteristic is the direct cause of the disadvantage.
