Definition
Under the New York City Human Rights Law (NYCHRL), an 'unlawful discriminatory practice' refers to any action by an employer, employment agency, employee, or agent thereof that violates the provisions of the law. Local Law 32 of 2022 specifically amends Section 8-107 of the NYCHRL to classify the failure to state the minimum and maximum salary for a position in an advertisement as an unlawful discriminatory practice. This classification enables the New York City Commission on Human Rights to investigate complaints and impose penalties, and for current employees to pursue legal action.
