Unfair Termination
The termination of a worker's employment by an employer for reasons deemed unlawful or without following fair procedure, as defined by the Labour Act.
Definition
Section 63 of the Ghana Labour Act 2003 outlines specific grounds that constitute unfair termination of employment. These include termination based on a worker's trade union membership or activities, gender, race, disability, pregnancy, or filing a complaint against the employer. A termination may also be deemed unfair if the employer fails to prove a fair reason or that a fair procedure was followed. Workers whose employment is unfairly terminated have the right to present a complaint to the National Labour Commission, which can order remedies such as reinstatement, re-employment, or compensation.
