The right to information (Informationsskyldighet) mandates that employers regularly provide employee organizations, with whom they are bound by a collective agreement, with comprehensive information. This includes details on the company's economic and production development, as well as guidelines for personnel policy. This right is crucial for enabling unions to effectively prepare for negotiations, scrutinize employer decisions, and represent their members' interests, including in matters related to remuneration and pay equity.
The Auskunftsanspruch, or right to information, grants employees the ability to request specific data from their employer regarding their individual remuneration and the average gross remuneration of a comparable group of employees of the opposite sex performing equal or equivalent work. The Entgelttransparenzgesetz Reform 2025 significantly expands this right by lowering the applicable company size threshold and broadening the scope of information to be provided, aiming to empower employees to identify potential pay discrimination.
