The Right of Consent (Instemmingsrecht), outlined in Article 27 of the Works Council Act, is a powerful right granted to the works council. It means that an employer cannot introduce, amend, or withdraw regulations concerning specific social policy matters, such as remuneration systems, job evaluation systems, working hours, or personnel assessment policies, without the explicit approval of the works council. A decision implemented without this consent is invalid and can be nullified by the works council, ensuring employee representatives have a decisive say on these critical issues.
