Any payment an employer is legally obliged to make to an employee.
Definition
The 'required amount' encompasses any payment an employer is mandated to make to, or on behalf of, an employee. This includes, but is not limited to, wages, allowances, superannuation contributions, and leave entitlements. The obligation to pay these amounts arises under the Fair Work Act 2009 (Cth), a fair work instrument (such as a modern award or enterprise agreement), or a transitional instrument. The intentional failure to pay this 'required amount' constitutes the core element of the criminal wage theft offence.
