Racial Discrimination
Treating a person less favourably on the ground of their race, or applying a condition that disproportionately affects a racial group without justification.
Definition
Under the Race Discrimination Ordinance, racial discrimination occurs when a person treats another person less favourably on the ground of the race, colour, descent, national or ethnic origin of that other person or a near relative of that other person (direct discrimination). It also includes indirect discrimination, where a requirement or condition is applied equally to persons of different racial groups, but the proportion of persons of the same racial group who can comply with it is considerably smaller, and the requirement or condition cannot be shown to be justifiable.
