Definition

The concept of 'Puesto de Igual Valor' (Job of Equal Value) is central to Peru's equal pay legislation, moving beyond the traditional 'equal pay for equal work' to embrace 'equal pay for work of equal value' or comparable worth. A job is considered of equal value to another if, after an objective evaluation, it is determined that both positions require similar levels of skills, effort, responsibility, and are performed under comparable working conditions. This objective evaluation must consider factors such as the complexity of tasks, required qualifications, physical and mental demands, decision-making autonomy, and the environment in which the work is carried out. The law explicitly mandates that employers establish a system for evaluating jobs based on these objective criteria to identify and address any discriminatory pay gaps between positions deemed to be of equal value, regardless of their specific job titles or departmental location.
