Temporary agency workers must receive the same basic working and employment conditions, including pay, as if directly recruited by the user undertaking for the same job.
Definition
The 'principle of equal treatment' dictates that the basic working and employment conditions of temporary agency workers shall be, for the duration of their assignment at a user undertaking, at least those that would apply if they had been recruited directly by that undertaking to occupy the same job. This principle applies from the first day of the assignment, though derogations are possible under specific conditions.
