Objective Reasons
Legitimate, non-discriminatory justifications for differential treatment.
Definitions (2)
These are legitimate and verifiable reasons, unrelated to the worker's part-time status, that can justify differential treatment between part-time and comparable full-time workers. Such reasons must be based on genuine needs of the employer, such as the nature of the duties, specific skills required, or other demonstrable business requirements, and not on arbitrary distinctions.
'Objective reasons' are precise and concrete circumstances characterising a given activity that can justify different treatment for fixed-term workers or the renewal of fixed-term contracts. These reasons must not be based solely on the fixed-term nature of the contract itself but on genuine operational needs, such as the temporary nature of the work, specific project requirements, or seasonal demands, ensuring that any deviation from equal treatment is legitimate and non-discriminatory.
