Definition

While the Uruguayan Constitution, particularly Article 8, lays down a broad principle of equality, the concept of 'non-discrimination in employment' specifically extends this to the workplace. It implies that decisions regarding hiring, promotion, training, working conditions, and remuneration must be based on merit, qualifications, and performance, rather than on protected characteristics such as sex, race, age, or other factors unrelated to job performance. This constitutional directive forms the basis for national laws, like Law No. 16045, that explicitly prohibit discrimination in labor activities and aim to ensure equal treatment and opportunities for all workers.
