Definition

The concept of 'justificación objetiva y razonable' (objective and reasonable justification) is a critical component of the definition of non-discrimination in Ley N° 26772. It means that any requirement that leads to differentiated treatment in job offers or access to training must be demonstrably necessary and proportionate to the legitimate aims of the employment or educational program, and not merely an arbitrary preference. Requirements lacking such justification are deemed discriminatory and unlawful.
