Responsabilité solidaire

A scheme allowing workers to claim unpaid wages from certain third parties if the direct employer defaults.

Definition

'Responsabilité solidaire' (joint and several liability) refers to the legal scheme established by the Law of 12 April 1965, which, under specific conditions, allows a worker to obtain payment of due but unpaid wages from certain third parties (known as 'jointly and severally liable debtors') if their direct employer fails to pay. This mechanism provides an additional layer of protection for workers against wage default.
