Good Morals

A fundamental legal principle in the Czech Civil Code requiring legal acts and their interpretation to align with ethical standards and not cause cruelty or inconsiderate behavior.

Definition

The concept of 'good morals' (dobré mravy) is a core principle in the Czech Civil Code (Act No. 89/2012 Coll.). Section 2(3) stipulates that the interpretation and application of a legal regulation must not be contrary to good morals and must not lead to cruelty or inconsiderate behavior offensive to ordinary human feelings. Furthermore, Section 1(2) prohibits stipulations contrary to good morals. In the context of employment and pay equity, this principle implies that any contractual agreement or practice, including those related to remuneration, must adhere to fundamental ethical standards of fairness, decency, and non-exploitation, preventing arbitrary or discriminatory outcomes that would be considered morally objectionable and thus legally invalid.
