Any distinction, exclusion, or restriction based on sex that impairs or nullifies the recognition, enjoyment, or exercise of human rights and fundamental freedoms by women.

Definition

As defined by the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), and adopted by Costa Rican law, gender-based discrimination encompasses any difference in treatment based on sex that intentionally or unintentionally disadvantages women, prevents society from recognizing their rights, or hinders their exercise of human rights and fundamental freedoms in political, economic, social, cultural, civil, or any other field. This includes both direct and indirect forms of discrimination.
