Gender Discrimination, as defined and prohibited by the Gender Equality in Employment Act, refers to any form of unequal treatment of applicants or employees due to their gender or sexual orientation. This includes discrimination in recruitment, hiring, placement, assignment, evaluation, promotion, education, training, welfare provisions, and the payment of wages. The Act aims to eliminate such discrimination to foster substantive gender equality in the workplace.

Gender Discrimination refers to any form of differentiation, exclusion, or limitation that is based on an individual's sex and has the effect or purpose of nullifying or impairing the recognition, enjoyment, or exercise of human rights and fundamental freedoms in political, economic, social, cultural, civil, or any other field. This encompasses both direct and indirect forms of discrimination that disadvantage individuals due to their gender.

In the Moroccan context, particularly under the 2011 Constitution and the 2003 Labour Code, gender discrimination refers to any adverse treatment or distinction based on a person's sex that affects their rights and opportunities in employment, pay, advancement, or other social, economic, and political aspects. The Constitution mandates the state to combat all forms of discrimination, with a specific focus on achieving parity between men and women.

Discrimination on grounds of gender refers to the actions or inaction, which signify any distinction, exception or privilege on grounds of gender, provided that they aim to restrict the human rights and freedoms of women and men or make it impossible to recognize, use or exercise them on an equal footing. This includes both direct and indirect forms of discrimination.

Gender discrimination is defined as the restriction, exclusion, non-recognition, or disregard of the roles and positions of men and women, causing inequality between men and women in various aspects of social and family life. This includes any act that creates unequal opportunities or outcomes based on gender, whether direct or indirect.
