Equal Pay for Equal Work or Equal Value

Definition
This principle, enshrined in Article 10 of the Act of Gender Equality in Employment, mandates that employers shall not discriminate against employees based on their gender or sexual orientation in the payment of wages. Employees performing work that is the same or of equal value must receive equal pay. However, differentials resulting from justifiable, non-gender-related factors such as seniority systems, award and discipline systems, or merit systems are permissible. Employers are explicitly prohibited from reducing the wages of other employees to circumvent this stipulation, ensuring that the principle is upheld without adverse consequences for other staff.
