Employer (NYC LL32)

An entity with four or more employees (including owners, independent contractors, domestic workers) where at least one works in NYC, or any employment agency.

Definition

For the purposes of New York City Local Law 32 of 2022, an 'employer' includes any entity that has four or more persons in its employ at all times during the 12 months prior to an alleged unlawful discriminatory practice, provided at least one employee works in New York City. This count includes full-time and part-time employees, paid interns, domestic workers, business owners, family members employed by the business, and independent contractors working in furtherance of the employer's business enterprise. Additionally, employment agencies are considered 'employers' under this law regardless of their size. Temporary help firms are generally exempt when advertising for their pool of temporary workers.
