Employee-like Worker

Workers in the gig economy or road transport industry who are not traditional employees but for whom the FWC can set minimum standards.

Definition

The Act extends the powers of the Fair Work Commission (FWC) to set minimum standards for 'employee-like' workers, particularly those performing digital platform work (gig economy) and regulated road transport industry contractors. These workers, while not formally classified as employees, are recognized as potentially vulnerable and deserving of certain protections. The FWC can make minimum standards orders and guidelines covering aspects such as payment terms, working time, and dispute resolution, effectively providing a safety net for these non-traditional workers.
