Definitions (5)

An Arbeitnehmer, or employee, refers to any individual engaged in an employment relationship in Germany, regardless of the specific terms (e.g., full-time, part-time, temporary, mini-job). Under the Mindestlohngesetz, this broad definition ensures that most individuals performing work for an employer in Germany are entitled to receive at least the statutory minimum wage, with only specific, narrowly defined exceptions such as certain interns or apprentices.

German Minimum Wage ActDefinition 1 of 5

A person who agrees to work for the employer in return for wages, irrespective of the specific title given to such a relationship. This broad definition ensures that all individuals performing work under an employment contract for remuneration are afforded the protections of the Act, regardless of their contractual designation.

Initially defined as a regular or contractual employee, including interns or apprentices, the definition of 'employee' was expanded through amendments to mean a person employed for any work, including home-based workers, of any age, on regular, temporary, ad hoc or daily wage basis; either directly or through an agent, including a contractor, with or without the knowledge of the principal employer, whether for remuneration or not or working on a voluntary basis or otherwise, whether the terms of employment are express or implied and includes a co-worker, a contract worker, probationer, trainee, apprentice or called by any other such name and domestic workers of any age employed to do any household work for remuneration whether in cash or kind, either directly or through any agency on a temporary, permanent, part-time or full-time basis.

Within the QFC Employment Regulations, an 'Employee' encompasses any individual who is a Sponsored Employee, a Qatari national, or a person sponsored in the State by a member of their family, and who is engaged in employment by an Employer. This broad definition ensures that the protective provisions of the regulations extend to all workers within the Qatar Financial Centre, irrespective of their nationality or specific sponsorship arrangements. The classification is crucial for determining applicable rights and obligations under the QFC framework.

An employee, according to Law No. 66/2018, is any individual who, in return for remuneration, carries out work under the direction and authority of an employer. This includes individuals working in both the private and public sectors, as well as apprentices and interns, provided their relationship is governed by an employment contract, thereby extending legal protections to a diverse workforce.
