Definition

Within the framework of the Employment (Equal Pay for Men and Women) Act, discrimination on the grounds of sex specifically refers to an employer's failure to provide equal pay for equal work between male and female employees. The Act explicitly prohibits employers from discriminating between male and female employees employed by them in the same establishment in Jamaica by not paying equal remuneration for similar work. While the Jamaican Constitution does not explicitly provide protection against discrimination on the grounds of sex, this Act directly addresses pay discrimination in employment.
