Discrimination on Grounds of Disability
Any distinction, exclusion or restriction made on the basis of disability which has the purpose or effect of impairing or nullifying the recognition, enjoyment or exercise, on an equal basis, of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field.

Under Section 4(1) of the Ghana Persons with Disability Act, 2006 (Act 715), 'A person shall not discriminate against, exploit or subject a person with disability to abusive or degrading treatment.' More specifically in employment, Section 4(2) clarifies that 'An employer shall not discriminate against a prospective employee or an employee on grounds of disability unless the disability is in respect of the performance of the essential duties of the job.' This definition prohibits unfair treatment, exploitation, or any action that disadvantages an individual solely because of their disability, particularly in the context of employment, unless the disability directly prevents the performance of core job functions.
The Act defines 'discrimination' as any distinction, exclusion, or restriction on the basis of disability which has the purpose or effect of impairing or nullifying the recognition, enjoyment, or exercise, on an equal basis with others, of privileges, legal interests, rights, benefits, and treatment, in any field. This includes all forms of discrimination, notably the denial of reasonable arrangements. In the employment context, this specifically prohibits offering different terms and conditions of employment, such as wages, due to a person's disability.
