Definition
Indirect discrimination on the grounds of sex occurs when an apparently neutral provision, criterion, or practice places persons of one sex at a particular disadvantage compared to persons of the other sex, unless that provision, criterion, or practice can be objectively justified by a legitimate aim and the means of achieving that aim are appropriate and necessary. The law seeks to identify and eliminate these subtle forms of discrimination that perpetuate gender inequality.
