'Discriminación Salarial' (Wage Discrimination) refers to any direct or indirect distinction, exclusion, or preference based on sex (or other protected characteristics) that nullifies or impairs equality of opportunity or treatment in remuneration. This is a very serious infraction under LISOS when it violates the principles established in the Workers' Statute and Royal Decree 902/2020.
Wage discrimination refers to any disparity in remuneration that is not founded on objective, demonstrable, and justified criteria related to the job itself, such as capacities, qualifications, suitability, responsibility, productivity, or seniority. Crucially, under Costa Rican law, differences in pay that are based solely on a person's sex, maternity status, age, ethnicity, religion, sexual orientation, or disability are considered arbitrary and unlawful. This concept is central to the enforcement of equal pay principles and is prohibited by the Labor Code, the Constitution, and specific anti-discrimination laws.
