Under Article 404 of Ley N° 9343, discrimination is broadly prohibited in the workplace. This includes any distinction, exclusion, or preference based on age, ethnicity, sex, religion, race, sexual orientation, marital status, political opinion, national origin, social origin, filiation, disability, union affiliation, economic situation, or any other analogous form that has the effect of nullifying or impairing equality of opportunity or treatment in employment or occupation. This comprehensive definition aims to protect workers from unfair treatment across a wide range of personal attributes.

Discriminación (Discrimination) refers to any act or disposition, direct or indirect, that promotes discrimination or prevents persons with disabilities from having access to programs and services, or limits their equal opportunities in areas such as accessibility, employment, education, health, and transportation, based on their disability. Ley 7600 aims to eliminate all types of discrimination against persons with disabilities.

Under Ley N° 26772, 'discriminación, anulación o alteración de igualdad de oportunidades o de trato' (discrimination, annulment or alteration of equality of opportunities or treatment) refers to requirements for personnel or access to technical or professional training that are not provided for by law and imply differentiated treatment devoid of an objective and reasonable justification, based on motives such as race, color, sex, religion, opinion, national origin or social origin, economic condition, political condition, marital status, age or any other kind. This broad definition ensures comprehensive protection against various forms of prejudice in the labor and educational spheres.
