Data concerning health, as protected by the Act on the Protection of Privacy in Working Life, refers to sensitive personal data that reveals information about an individual's health status. This includes medical diagnoses, sick leave records, drug test results, and any other information related to an employee's physical or mental health. The Act imposes stringent restrictions on the processing of such data, allowing it only under very specific, legally defined circumstances, such as for the payment of sick pay or to assess working capacity at the employee's explicit request, even overriding employee consent for broader processing.
