Constitutional Supremacy
The principle that the Constitution is the supreme law and all other legal norms must conform to it.
Definition
As established in Article 17 of the Constitution, Constitutional Supremacy means that the Constitution stands as the highest legal authority in Peru. All other laws, decrees, and regulations must be consistent with its provisions, and any legal norm that contradicts the Constitution is considered invalid. This principle ensures that fundamental rights, including those related to pay equity and labor, are protected against conflicting ordinary legislation.
