Einigungsstelle
A neutral committee for resolving disputes between employers and works councils.
Definition
The Einigungsstelle, or conciliation committee, is a neutral body established under the Betriebsverfassungsgesetz to resolve disputes between an employer and the works council, particularly in matters where the works council has an enforceable co-determination right. It is typically composed of an equal number of representatives from both sides and a neutral chairperson agreed upon by both parties or appointed by the labor court. Its decisions are often binding, providing a crucial mechanism for internal dispute resolution and ensuring the implementation of works council rights.
