Mandatory pre-judicial conciliation process before initiating a labor lawsuit.

Definition

Conciliación Previa (Prior Conciliation) is a fundamental procedural step mandated by the Uruguay Labor Process Law. Before any individual labor lawsuit can be formally initiated before the judicial power, the parties involved—the worker and the employer—are required to attempt a conciliation process. This process takes place before the Center for Negotiation of Individual Labor Conflicts in Montevideo or the Zonal Agency of the Ministry of Labor and Social Security in other parts of the country. The aim is to resolve disputes amicably and efficiently outside of formal litigation, thereby reducing the burden on the judicial system and promoting faster resolution for workers. The request for conciliation must be in writing, detailing the facts and the amounts claimed, unless the claim is for sums below a certain threshold (20 readjustable units).
