Mitbestimmung, or co-determination, is a core principle of German labor law, particularly under the Betriebsverfassungsgesetz. It refers to the right of the Works Council to participate in the employer's decision-making processes. This participation can range from rights to information and consultation to 'erzwingbare Mitbestimmung' (enforceable co-determination), where the employer cannot implement certain measures (especially in social matters like remuneration systems or working hours) without the Works Council's explicit agreement. In cases of disagreement, a conciliation committee (Einigungsstelle) may be invoked, whose decisions can be binding.
Co-determination (soupravljanje) is a strong form of worker participation where the employer requires the consent or joint decision of the workers' council for specific strategic or operational decisions. Under the ZSDU, this right extends to critical matters such as significant changes in the organization of work or social plans, ensuring that employees have a direct say in decisions that profoundly affect their working lives and the company's future.
Co-determination (Medbestämmande) refers to the statutory right of employees and their organizations to participate in and influence decision-making processes within the workplace. This includes rights to information, negotiation, and in some cases, a temporary right of veto, on matters concerning the employer-employee relationship, significant changes in operations, and working conditions. It is a cornerstone of Swedish labor law, aiming to foster industrial democracy and balance power between employers and employees.
