Burden of Proof (Reversal)
In discrimination cases, once a victim presents facts suggesting discrimination, the employer must prove no discrimination occurred.
Definition
The reversal of the burden of proof, a key procedural safeguard in Law 3896/2010, stipulates that in civil and administrative proceedings concerning discrimination claims, once an employee presents facts from which discrimination may be presumed, it is then incumbent upon the employer to prove that no discrimination occurred. This mechanism aims to alleviate the evidentiary burden on victims of discrimination, making it easier to pursue claims.
