Definition
Benachteiligung, or discrimination, refers to any less favorable treatment of a person compared to another in a comparable situation, based on one of the protected characteristics outlined in the AGG. This can manifest as direct discrimination, indirect discrimination, harassment, sexual harassment, or an instruction to discriminate. The law focuses on the detrimental effect of the unequal treatment, rather than necessarily requiring malicious intent.
