The individual right of employees to request information about pay criteria and comparative salaries.
Definition
The 'Auskunftsanspruch' (right to information) grants employees in establishments with more than 200 employees the right to request information about the criteria and procedures used for their own pay determination, as well as the average monthly gross salary and up to two individual pay components (e.g., performance bonuses, hardship allowances) for a comparable activity performed by employees of the opposite sex. This information is provided as a median, requiring at least six employees of the other sex in a comparable role to ensure data protection. The request must be made in text form, and the employer or works council must respond within three months.
