Arbeitszeitaufzeichnungspflicht
The employer's legal obligation to record the working hours of certain employees.
Definition
Arbeitszeitaufzeichnungspflicht is the duty imposed on employers by § 17 MiLoG to record the beginning, end, and duration of the daily working time for specific categories of employees. This obligation primarily applies to minijobbers and employees in sectors particularly susceptible to undeclared work, such as construction, hospitality, and logistics. These records must be kept for at least two years and are crucial for the Finanzkontrolle Schwarzarbeit (FKS) to monitor and enforce minimum wage compliance.
