Applicant for Employment

The Transparent and Predictable Working Conditions (Amendment) Regulations, 2025, introduces and defines 'applicant for employment' as any person actively seeking employment and who is currently under consideration for engagement by a prospective employer. This definition broadens the scope of protection under employment law to individuals at the pre-employment stage, granting them specific rights related to pay transparency before an employment relationship is formally established. This is a significant shift, as previously, many employment rights were primarily afforded to existing employees.

Any person who applies for a job opening. Under SB 293, applicants who have completed an interview are entitled to receive the wage or salary range or rate for the position, empowering them with critical compensation information.
