Definitions (3)
As defined by New York City Local Law 32 of 2022, an 'advertisement' encompasses any written communication that publicizes an available job, promotion, or transfer opportunity to a group of potential applicants. This broad definition includes, but is not limited to, postings on internal company bulletin boards, online job boards, company career websites, social media platforms, printed flyers distributed at job fairs, and newspaper advertisements. The key is that it is a written description made public to solicit interest or applications for a position that can be performed, in whole or in part, in New York City.
Under Act 102, an 'advertisement' is defined as any written notice, in any format, of a specific job opening that is made available to potential applicants. This includes online postings, print ads, and internal communications like emails for specific roles. It explicitly excludes general announcements of employment opportunities without specific job openings or purely verbal announcements.
The term 'advertisement' under the New York Pay Transparency Law broadly encompasses any written description of a job, promotion, or transfer opportunity that is publicized to a pool of potential applicants. This includes, but is not limited to, postings on company websites, external job boards, social media, printed materials, and electronic communications, whether for internal or public viewing.
