Adverse Treatment

Definition

Adverse treatment, as reinforced by Law no. 283/2022, refers to any unfavorable action, decision, or omission by an employer that negatively impacts an employee's working conditions, career prospects, or overall employment relationship. This includes, but is not limited to, dismissal, demotion, harassment, or denial of opportunities. The law explicitly prohibits adverse treatment against employees and their representatives for requesting or exercising rights recognized by the Labour Code, providing a basis for legal recourse and compensation.
